Online bingo is currently in a regulatory transition period in Kenya, as the existing Betting, Lotteries and Gaming Act (Cap 131) does not address online gambling activities (1). However, Kenya's Parliament has enacted the new Gambling Control Bill 2023, which specifically includes comprehensive provisions for online gambling licensing and regulation. Under this new legislation, online bingo will be explicitly regulated by the Gambling Regulatory Authority, which replaces the Betting Control and Licensing Board (1).
The Gambling Control Bill 2023 establishes a formal licensing framework for online gambling operators, including specific provisions for online bingo platforms (1). Online operators will be required to deposit a minimum of KES 200 million (approximately USD 1.3 million) and maintain at least 30 percent Kenyan shareholding to obtain licensing. The legal age for online gambling is set at 18 years, and operators must implement strict player registration, account management, and responsible gambling measures. The Authority will have powers to inspect, monitor compliance, and enforce financial reporting requirements for all online gambling licensees (2).
"In view of these occurrences, and pursuant to its statutory mandate under the Betting, Lotteries and Gaming Act, the Betting Control and Licensing Board hereby orders the immediate suspension of all gambling advertisements and testimonials across all media platforms for a period of 30 days."
The regulatory landscape for online bingo in Kenya is evolving rapidly with the implementation of the new Gambling Control Act (2). Authorities have implemented interim measures including suspensions of gambling advertisements to address gambling addiction concerns and protect vulnerable players, particularly minors. Once the Gambling Control Bill is fully implemented, online bingo operators must comply with strict codes of practice on fair gaming, player protection, data security, and responsible marketing. Players should anticipate that the new regulatory framework will establish clear guidelines, licensing requirements, and consumer protections for online bingo. The government's comprehensive approach to gambling regulation reflects Kenya's commitment to balancing industry growth with consumer protection and social responsibility.
