Online gambling in Fiji is strictly prohibited under the Gaming Act 2009, which serves as the primary legislation governing all gaming activities in the country (1). The act prohibits all forms of gambling unless specifically exempted by law. Remote interactive gaming, which includes online gambling such as online bingo, is explicitly restricted to telephone, radio, and television platforms only, meaning internet-based gaming operations are not permitted.
The Fiji Revenue and Customs Service administers gambling regulation through the Gaming Act 2009 and Gambling Turnover Tax Act 1991 (1). Gaming activities are classified into four categories: Class I for charitable gambling, Class II for commercial land-based gambling, Class III for large-scale casinos, and special permits for state-regulated lotteries and sports betting. However, no licenses are issued for online gaming activities, and the act does not permit internet-based gambling operations to obtain legal authorization in Fiji.
"From that, it is obvious that online gambling is strictly off limits, but operators still find ways to make online gambling possible in the country, due to the fact that laws apply specifically to Fijian businesses and not to the overseas operators" (2).
Individuals and operators involved in unlicensed online gambling activities face significant legal consequences under Fijian law. Players engaging in illegal gambling are subject to fines of $5,000 or imprisonment for up to 2 years (2). The Gambling Act imposes very severe penalties for those who run a gambling business without a license, reflecting the government's strict stance against unauthorized gaming operations in the country.
